Client App Terms of Service

1. Who We Are and What Continuum Is

The Continuum app ("App") is operated by Continuumco Ltd, a company registered in England and Wales (company number 15602004), with its registered office at 26 Charlwood Road, London, SW15 1PW ("Continuum", "we", "us", or "our").

The App is a between-session engagement and behavioural tracking tool. It is designed to support the work of your private practitioner by helping you track your wellbeing, goals, and progress between sessions.

The Continuum App is NOT a clinical service, emergency service, or crisis support line. It is not a substitute for professional care. If you are in crisis or feel at risk of harm to yourself or others, please call 999, contact the Samaritans on 116 123, or go to your nearest A&E.

2. The App Is Not a Medical or Clinical Service

We want to be clear about what Continuum is and is not:

• The App is a wellness and behavioural support tool, not a medical device, clinical service, or regulated health intervention.
• Nothing in the App constitutes a diagnosis, clinical assessment, or clinical recommendation.
• Any AI-generated content in the App is designed to support your engagement with your practitioner's programme. It is not clinical advice and should not be treated as such.
• Continuum does not provide out-of-hours support or crisis services. The App should not be used in a mental health emergency.
• Your practitioner remains responsible for your care. If you have concerns about your health or wellbeing, please contact your practitioner directly.

3. Who Can Use the App

To use the App, you must:

• Be at least 18 years of age, unless your practitioner has confirmed appropriate arrangements are in place;
• Be a client of a practitioner who holds an active Continuum subscription;
• Have received an invitation to the App from your practitioner;
• Be receiving private (not NHS-funded) care from your practitioner.

The App is not available to clients receiving NHS-funded care. If your care changes and you begin receiving NHS-funded services, please stop using the App and inform your practitioner.

4. Your Account

You are responsible for keeping your login details secure and confidential. Do not share your account with anyone else. Please notify us immediately at contact@continuum.ac if you believe your account has been accessed without your permission.

Your account is personal to you and linked to your practitioner's account. If your practitioner ends their subscription to Continuum, your access to the App will also end.

5. How You May Use the App

You may use the App only for your own personal wellbeing support in connection with your private practitioner's programme. You must not:

• Use the App for any unlawful purpose;
• Attempt to access any part of the App or its underlying systems beyond what is made available to you;
• Use the App to harass, abuse, or harm any other person;
• Upload or share any content that is illegal, offensive, or infringes the rights of any third party;
• Attempt to reverse engineer, copy, or replicate any part of the App.

6. Your Data

We take the privacy of your personal data seriously, particularly given the sensitive nature of behavioural and mental health information. Our Privacy Policy explains in full how we collect, use, and protect your data.

In summary:

• Your data is shared with your practitioner as part of the service they provide to you.
• Continuum is the data controller for your personal data. Your practitioner remains responsible for the care they provide to you.
• We use sub-processors (including technology providers) to deliver the App. These are listed in our Privacy Policy.
• You have rights over your personal data, including rights of access, correction, and deletion, as set out in our Privacy Policy.

7. AI-Generated Content

The App includes features that use artificial intelligence to generate content, insights, or prompts related to your goals and progress. You should be aware that:

• AI-generated content is produced automatically and has not been reviewed or approved by your practitioner in real time.
• AI-generated content is not clinical advice and should not be treated as a substitute for the guidance of your practitioner.
• If anything generated by the App concerns or worries you, please raise it with your practitioner at your next session.

8. Intellectual Property

All intellectual property rights in the App, including its software, design, and content developed by us, are owned by or licensed to Continuumco Ltd. You may not copy, reproduce, or distribute any part of the App without our written permission.

Any content you create or input into the App (such as journal entries or goal descriptions) remains yours. By using the App, you grant us a limited licence to process that content for the purpose of providing the service to you and your practitioner.

9. Limitation of Liability

To the maximum extent permitted by law:

• We are not liable for any clinical outcomes or decisions made in connection with your use of the App.
• We are not liable for any indirect or consequential loss arising from your use of the App.
• Our total liability to you for any claim arising from your use of the App shall not exceed the amount (if any) paid by you directly to us in the preceding three months.

Nothing in these Terms excludes our liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.

10. Termination

You may stop using the App at any time by contacting your practitioner or by deleting your account through the App settings.

We may suspend or terminate your access to the App if you breach these Terms, if your practitioner's account ends, or if we discontinue the App with reasonable notice.

On termination, we will handle your data in accordance with our Privacy Policy.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of any material changes through the App or by email before they take effect. Continued use of the App after the effective date of updated Terms constitutes acceptance of those changes.

12. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
